I am letting my flat out. Do I need to tell the landlord?

Very much dependent on the terms of the lease – some will have a requirement that the consent of the landlord is obtained before any letting can take place – look through the lease, or have a solicitor look through it, to see if there is a relevant clause – if not then you are free to let, though it may be worthwhile informing the landlord and your neighbours anyway – if there are any problems then they will know where to contact you.

 

If there is a clause relating to letting it will probably require you to get the landlords consent – this usually cannot be refused unreasonably – however some leases require a more formal process including obtaining references and getting a licence from the Landlord – can take a while though there is usually no problem getting this

 

If buying a flat specifically to let tell your solicitor as they will review the lease to make sure it is permitted – some leases have a blanket ban on letting and some may prohibit it during the first few years of ownership – if this is the case then there will be no point in buying the flat.
